Title:  “Hitting the Reset Button – LGBT in the Workplace after the Obergefell Decision”

TOPIC:  In June 2015 the U.S. Supreme Court ruled in Obergefell v. Hodges that the United States Constitution requires all states to recognize same sex marriages.  This program will discuss the implications of the Obergefell decision for employers, and take a fresh look at where employers stand today on various LGBT issues in the workplace.  Highlights will include:

A brief history of developments regarding the rights of same-sex partners from DOMA to the Supreme Court’s decision in Windsor to the Obergefell case.

Implications of Obergefell for employers, particularly with respect to benefit programs including such items as:

  • Retirement plans
  • Health plans (including COBRA and HIPAA considerations)
  • Welfare benefit plans (cafeteria plans and dependent care assistance)
  • FMLA
  • QDROs
  • What are the impacts on governmental plans and church plans
  • Should employers retain their “domestic partner benefits” policies
  • Should employers require “proof” of a same sex marriage

A fresh look at the current state of various other legal issues potentially impacting the LGBT community in the workplace, including: 

  • Current sexual orientation, gender identity and LGBT laws on the books nationally
  • The EEOC’s position on sexual orientation and gender identity rights under Title VII
  • Where are the courts on this issue
  • Impact of Nebraska’s law prohibiting marital status discrimination       
  • Recent OSHA guidance on transgender employees and use of restrooms

This Session has been submitted for 1.5 hours of GENERAL CREDIT from the HR Certification Institute.

This Session has been submitted for 1.5 hours of recertification credit from the SHRM Preferred Provider program.  HRAM is recognized by SHRM to offer Professional Development Credits (PDCs) for the SHRM-CP or SHRM-SCP.
